1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of WebCrawlerAPI services, websites, APIs, dashboard, and related features (collectively, the "Service"), provided by 103 Labs, a company incorporated in the Netherlands ("WebCrawlerAPI," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into contracts.

3. Accounts and Security

  • You are responsible for all activity under your account and API keys.
  • You must keep credentials confidential and use reasonable security measures.
  • You must promptly notify us of any suspected unauthorized access.
  • We may suspend or rotate credentials if we detect abuse or compromise.

4. Service Description

The Service provides tooling for scraping and crawling publicly accessible web content through API and dashboard workflows. Features may evolve over time.

5. Your Responsibilities and Compliance

You are solely responsible for:

  • your use of the Service and all requests sent through your account;
  • compliance with applicable laws, regulations, and third-party rights;
  • compliance with target website terms, robots directives, and other access restrictions where applicable;
  • ensuring you have a lawful basis for any data you collect or process.

You must not use the Service for unlawful surveillance, credential theft, malware distribution, spam/phishing, sanctions evasion, or any activity that violates law or third-party rights.

6. Prohibited Use

You must not:

  • interfere with or disrupt the Service or bypass rate limits and safeguards;
  • reverse engineer, probe, or attempt unauthorized access to our systems;
  • use the Service to collect sensitive data in violation of law;
  • create multiple trial accounts to evade free-trial limits or abuse promotional credits;
  • use the Service to reproduce, distribute, or otherwise infringe copyrighted content without authorization.

7. Rate Limits

We reserve the right to impose rate limits on your use of the Service at any time. Rate limits are in place to prevent abuse of third-party websites, protect against unintentional DDoS-like traffic, and ensure fair use across all customers. Circumventing or attempting to circumvent rate limits is a violation of these Terms.

Current rate limit policies are described in our Rate Limits documentation. We may adjust limits at any time to protect the integrity of the Service and third-party services.

8. Data, Content, and Rights

  • Your Inputs/Instructions: You retain rights to data and instructions you submit to the Service.
  • Output: Subject to these Terms and applicable law, you may use output generated from your jobs.
  • License to Operate: You grant us a limited license to host, process, transmit, and store your inputs and outputs as needed to provide, secure, and improve the Service.
  • Platform IP: We retain all rights in the Service, software, documentation, and branding.

9. Privacy and Data Processing

Our collection and use of personal data are described in our Privacy Policy. Where applicable, data processing is governed by our Data Processing Agreement (DPA). A list of our subprocessors is available at webcrawlerapi.com/legal/subprocessor-list.

10. Billing, Subscriptions, and Taxes

  • Paid plans are billed on the schedule shown at purchase (monthly/annual or usage-based where applicable).
  • Fees are non-refundable except as required by law or as stated in the Refund Policy.
  • You are responsible for applicable taxes (excluding taxes on our net income).
  • We may change pricing with prior notice for future billing periods.
  • Failure to pay may result in suspension or termination.

11. Free Trial

Free trial access is for evaluation purposes only. Trial abuse (including creating multiple accounts to bypass limits) may result in restriction, suspension, or termination.

12. DMCA and Copyright Compliance

Using the Service to reproduce, distribute, or otherwise infringe copyrighted content without authorization is a violation of these Terms and may violate applicable law. Upon receiving a valid DMCA takedown notice or becoming aware of credible infringement claims, we will take appropriate action, which may include any of the following at our sole discretion:

  • Blocking access to specific URLs or pages involved in the reported infringement
  • Restricting access to specific websites or domains through the Service
  • Suspending or terminating the account associated with the infringing activity

To submit a copyright infringement notice, contact us at support@webcrawlerapi.com with: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the material claimed to be infringing and its location; (3) your contact information; (4) a statement of good faith belief that the use is not authorized; and (5) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

13. Suspension and Termination

We may suspend or terminate access if we reasonably believe you violated these Terms, caused security risk, failed to pay fees, or used the Service in a way that may create legal or operational harm.

Upon termination:

  • your right to use the Service ends immediately;
  • outstanding payment obligations remain due;
  • sections that by nature should survive termination remain in effect (e.g., IP, disclaimers, liability limits, indemnity, dispute terms).

14. Appeals

If your account has been suspended or terminated and you believe the action was taken in error, you may appeal by contacting us at support@webcrawlerapi.com within 30 days of the action. Include your account details and a description of why you believe the action was incorrect. We will review your appeal and respond within 30 days. We reserve the right to make the final decision on all appeals.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR FULLY SECURE OPERATION.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

17. Force Majeure

We will not be liable for any failure or delay in performance of our obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather events, war, terrorism, civil unrest, government action, power or internet outages, third-party service failures, or other events outside our reasonable control. We will make reasonable efforts to resume performance as soon as practicable.

18. Indemnification

You agree to defend, indemnify, and hold harmless WebCrawlerAPI and its affiliates, officers, employees, and agents from third-party claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

19. Export Controls and Sanctions

You represent that you are not located in, organized under, or ordinarily resident in a restricted jurisdiction, and not on any denied-party list. You agree to comply with applicable export control and sanctions laws.

20. Changes to Service or Terms

We may update the Service and these Terms from time to time. If we make material changes to these Terms, we will provide reasonable notice (for example, by posting an updated date, dashboard notice, or email). Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

21. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, excluding conflict-of-law principles. Any dispute will be resolved in the competent courts of the Netherlands, unless otherwise required by applicable law.

22. General Terms

  • These Terms are the entire agreement regarding the Service and supersede prior agreements on the same subject.
  • If a provision is unenforceable, remaining provisions remain in effect.
  • Failure to enforce a provision is not a waiver.
  • You may not assign these Terms without our prior written consent; we may assign in connection with merger, acquisition, or asset sale.
